§ 1 Information on the Collection of Personal Data


In what follows, the owner and operator of the website (‘website’), capiton AG (cf. Section 1.2, ‘capiton’, ‘we’, ‘us’, ‘our’) is providing information on the col-lection of personal data occurring when you are using our website. Personal data are all data that can be related to you in person, e.g. name, address, e-mail addresses, user behaviour.

§ 2 Your Rights


If you

  • wish to view, confirm, correct, rectify, update, amend, anonymise, block, restrict, or erase your personal data;
  • wish to object to or restrict the use of your personal data by us;
  • have questions concerning the processing of your personal data; or
  • want us to pass on your personal data to another person or another enterprise,

please get in contact with us via the contact data given in Section 1.2.


With regard to your personal data, we assign to you all rights to which you are entitled according to law. In case of complaints on the handling of your personal data you may turn to a supervisory authority (Article 13(2)(d) GDPR). Alternatively, you may also turn to us via the contact data given in Section 1.2.


§ 3

Objection or Revocation of Consent


In case you declared consent into processing your data, you may revoke it at any time by informing us via the contact data given in Section 1.2. Such revo-cation affects the permissibility of the processing of your personal data after you have declared it to us.


Insofar as we base the processing of your personal data on balance of inter-ests (Article 6(1)(1)(f) GDPR), you may lodge an objection against processing. This is the case if processing, in particular, is not necessary for fulfilling a con-tract with you, which is described by us, respectively, in the following descrip-tion of functions. We ask you to present, when exerting such objection, the reasons for which your personal data should not be processed as done by us. Upon objection, we will check the facts and either suspend or adjust data pro-cessing or present to you our compelling reasons worthy of protection for which we maintain processing.


§ 4

Collection, Processing, and Use of Your Data


When you are using our website merely informationally, that is, when you do not regis-ter nor otherwise transmit information to us, we are only collecting the personal data that your browser is transmitting to our server. In this case, we are collecting the fol-lowing data, which we require technically in order to show you our website and to en-sure stability and safety (the legal basis being Article 6(1)(1)(f) GDPR, with our legiti-mate interest being the technical possibility of operating the website):

  • IP address;
  • Date and time of request;
  • Time zone difference to Greenwich Mean Time (GMT);
  • Content of request (particular page);
  • Access status/HTTP status code;
  • Individual amount of data transferred;
  • Website from which the request originates;
  • Browser;
  • Operating system and its surface; and
  • Language and version of browser software.

The IP addresses collected will be stored in anonymised form for a period of sixty days by our hosting provider Mittwald. You can find further information on the storage period with regard to the data collected pusuant to this Section 4.1 in Mittwald’s Data Protection Declaration.


Apart from this, we are processing your personal data only if

a) there is a legitimate interest in the context of the operation of our website, in particular:

  • For answering inquiries;
  • For providing service and/or information directed to you;
  • For the operation and administration of our website;
  • For avoiding and discovering case of fraud and criminal acts; and/or
  • For ensuring network and data security, insofar as these interests are in accordance with the law and with the rights and freedom of the user;

b) you consented into the use for individually specified lawful purposes; or

c) we are obliged to do so out of legal reasons.


§ 5

Erasure of Stored Data

  Your personal data stored will be erased (notwithstanding the particular erasure periods given in this Data Protection Declaration) insofar as there are no conflicting statutory duties of reten-tion or the personal data are no longer necessary for their purpose pursuant to Section 17 GDPR, in particular after revocation of a relevant consent (see for this Section 3 of this decla-ration). If further retention of the personal data serves a purpose permissible according to statute, their processing is restricted pursuant to Section 18 GDPR by blocking these data and not processing them anymore. This particularly holds for data that have to be retained for statutory reasons.  

§ 6

Use of Google Analytics


This website uses Google Analytics, a web analysis service by Google Inc. (‘Google’). Google Analytics uses Cookies, that is, text files that are saved on your computer and that allow for an analysis of your usage of the website. The information on your usage of the website created by the cookie will, according to Google, generally be transmitted to a Google server in the US and saved there. In case of activation of IP anonymisa-tion on this website, your IP address will be shortened in advance within Member States of the European Union of other Contracting States to the Agreement on the Eu-ropean Economic Area. Only in exceptional cases, the full IP address will be trans-ferred to a Google server in the US and shortened there. Google will use this infor-mation on behalf of the operator of the website in order to analyse your usage of the website, in order to compile reports on website activities, and in order to provide fur-ther services connected to the use of the website and the use of the internet vis-à-vis the website operator.


According to Google, the IP address transmitted by your browser in the context of Google Analytics will not be merged with other Google data.


You can prevent the saving of the cookies by making the relevant settings in your browser software; however, we point out to you that in this case, you might not be able to fully use all functionalities of this website. Furthermore, you can prevent the collection of data created by the cookie and related to your usage of the website (including your IP address) to Google as well as the processing of these data by Google by downloading and installing the browser plugin available under the following link: Browser-Plug-in.


This website uses Google Analytics with the extension ‘_anonymizeIp()’. By this, IP ad-dresses will be processed in shortened form, which excludes them from being able to re-late in person. Insofar as data collected on you relate in person, this relation, as a result, will be excluded instantaneously and by this, the personal data will be deleted immediately.


We make use of Google Analytics in order to be able to analyse and regularly improve us-age of our website. Through the statistics obtained, we are able to improve our service and make it more interesting for you as a user. For the cases of exception, in which personal data are being transmitted into the US, Google has submitted to the EU-US Privacy Shield, EU-US Privacy Shield. The legal basis for the use of Google Analytics is Article 6(1)(1)(f) GDPR, our legitimate interest being the provision of an interactive and user-friendly web service and its continuous optimisation.

§ 7

Use of Webalizer


This website is using Webalizer, a web analysis service by Mittwald CM Service GmbH & Co. KG (‘Mittwald’). Webalizer allows to collect, compile and analyse data on the behaviour of users on the website.


The user data collected for purposes of analysis via Webalizer will be anonymised, according to Mittwald, through technical procedures, so that attributing the data to the respective user is no longer possible. According to Mittwald, the data will not be stored together with other personal data of the users.


The legal basis for the use of Webalizer is Article 6(1)(1)(f) GDPR, our legitimate interest being the provision of an interactive and user-friendly web service and its continuous optimisation. You can find further information on data processing by Mittwald here.


§ 8

Embedding of Youtube-Videos


YouTube videos are embedded in our online services, which are saved on YouTube and which can be played directly from our website. They are embedded in ‘privacy-enhanced mode’, which means that no data on you as user will be transmitted to YouTube unless you play the videos. Only when you play the videos, the data listed in Section 8.2 will be transmitted. We have no influence on this data transmission.


Upon relevant activity, YouTube obtains the information that you have opened the respective subpage of our website. In addition, the data listed in Section 4.1 of this Declaration will be transmitted. This occurs independently of whether YouTube provides a user account through which you are logged in or whether there is no user account. If you are logged in with Google, to which the YouTube service belongs, your data will be attributed directly to your account. If you do not desire the attribution with your YouTube profile, you have to log off prior to activating the button. If you do not desire the attribution with your YouTube profile, you have to log off prior to activating the button. YouTube will save your data as usage profiles and may use them for purposes of advertising, market research, and/or demand-oriented design of its website. In particular, such analysis may occur (even for users not logged in) in order to provide demand-oriented advertisement and, potentially – depending on the service of the provider –, in order to inform other users of the social network on your activities on our website in connection with the service. You have the right to object to the formation of these user profiles, for the exertion of which you have to turn to YouTube.


You can obtain further information on purpose and scope of data collection and processing by YouTube from YouTube’s Data Protection Declaration. From there, you can also obtain further information on your rights in this regard and potential settings for the protection of your privacy. Google also processes your personal data in the US and has submitted to the EU-US Privacy Shield.


§ 9

News E-Mail; capiton aktuell


On our website, you can subscribe to our news e-mail with which we inform you on news concerning capiton and its portfolio companies. In addition, you can also subscribe to our digital magazine capiton aktuell through which you will obtain more detailed information on capiton and its portfolio companies.


We are using the so-called double opt-in procedure for the registration with our news e-mail and capiton aktuell. This means that after your registration, we will send you an e-mail to the e-mail address given in which we ask you to confirm that you wish the news e-mail or capiton aktuell to be sent. Unless you confirm your registration within 24 hours, your information will be blocked and, after one month, erased. Furthermore, we will save the IP addresses you used in the relevant cases and the times of registration and confirmation. The purpose of this procedure is to prove your registration and, potentially, to resolve a misuse of your personal data.


The only mandatory information for sending the news e-mail and capiton aktuell is your e-mail address. Providing further data separately marked is voluntary and is used in order to be able to address you in person. After your confirmation, we will save your e-mail address for the purpose of sending you the news e-mail or capiton aktuell; when you unsubscribe from the news e-mail or capiton aktuell, your e-mail address as well as other data potentially collected in connection with delivery will be erased within two weeks, insofar as the data may not be retained on the basis of consent independent of the news e-mail or capiton aktuell or on another legal basis (see Article 17(1)(b) GDPR). The legal basis for data processing pursuant to this Section 9 is Article 6(1)(1)(a) GDPR.


Your may revoke your consent into sending the news e-mail or capiton aktuell at any time and unsubscribe from the respective service. You may declare revocation by clicking on the link provided in each news e-mail, or, respectively, in each capiton aktuell delivery e-mail or by notifying us via the contact data given in Section 1.2.
